TERMS OF PROFESSIONAL SERVICE
Standard engineering inspection terms, operational scope boundaries, and client site responsibilities governing Aquifer & Vessel Integrity Services Inc.
EFFECTIVE DATE: JANUARY 1, 2026 // AVIS-TERMS-REV2
1. AGREEMENT TO TERMS
These Terms of Professional Service ("Terms") govern all engineering consultations, preliminary scope estimates, in-service submersible ROV audits, ultrasonic thickness testing, and regulatory compliance reporting provided by Aquifer & Vessel Integrity Services Inc. ("AVIS") to municipal utilities, rural water districts, industrial facilities, and commercial clients ("Client").
2. PROFESSIONAL STANDARDS OF CARE
All inspections, testing, and report deliverables are conducted in accordance with prevailing industry standards, including:
- AWWA D100 & AWWA M42: Welded Carbon Steel Water Storage Tanks; Manual of Water Supply Practices.
- AWWA D103: Factory-Coated Bolted Carbon Steel Tanks.
- AWWA C652: Disinfection of Water-Storage Facilities (Method 2 Chlorination Protocols).
- NFPA 25 (Chapter 9): Standard for the Inspection, Testing, and Maintenance of Water-Based Fire Protection Systems.
- ASTM E797 & ASNT SNT-TC-1A: Standard Practice for Measuring Thickness by Manual Ultrasonic Pulse-Echo Contact Method.
3. CLIENT SITE ACCESS & OPERATIONAL RESPONSIBILITIES
To permit safe and effective robotic deployment, Client agrees to:
- Provide clear, unobstructed vehicular access to the tank base for our mobile telemetry field trailers.
- Ensure tank access ladders, safety climb cables, roof platforms, and perimeter railings meet basic OSHA structural standards.
- Provide access to a sanitary roof hatch with a minimum clear opening diameter of 20 inches.
- Maintain water column clarity sufficient for optical imaging (turbidity preferably < 1.5 NTU; where excessive suspended solids obscure optics, acoustic sonar profiling will be utilized as the primary imaging medium).
4. LIMITATION OF LIABILITY & WARRANTY
AVIS exercises rigorous professional engineering diligence. However, ultrasonic thickness testing and visual submersible inspections reflect conditions present at the specific date and hour of examination. AVIS does not warrant against latent subsurface metallurgical defects, soil-side foundation subsidence beyond accessible measurement points, or chemical changes in municipal water chemistry occurring post-inspection.
Under no circumstances shall AVIS's aggregate liability exceed the total fee paid for the specific inspection engagement under which the claim arose.
5. REGULATORY SUBMISSIONS & STAMPED REPORTS
Deliverable engineering reports are signed and certified by Hank Caldwell (AMPP CIP #28419, ASNT Level III) and/or a licensed Professional Engineer (PE). While our reports are formulated to satisfy state Department of Environmental Quality (DEQ) and fire marshal requirements, final regulatory determination remains under the statutory jurisdiction of the governing authority.
6. GOVERNING LAW & JURISDICTION
These Terms shall be interpreted and enforced under the laws of the State of Oklahoma. Any legal dispute arising hereunder shall be subject to the exclusive jurisdiction of the state or federal courts located in Tulsa County, Oklahoma.
